– the Seller – on the terms and conditions set out below. The purchaser is the consumer who places the order, and is designated in the following as the Purchaser.
This purchase is regulated by the Standard Sales Conditions for Consumer Purchases of Goods over the Internet, given below. The terms of the contract are not to be understood as a limitation on legal rights but present the parties’ most important rights and duties in regard to the purchase. These terms and conditions of sale are additional to and not a substitute for your statutory rights.
1. PURCHASE OF PRODUCTS FROM APOLLON RECORDS, ONLINE
The descriptions on the website, of the products supplied by seller APOLLON RECORDS AS are necessarily subjective but are intended to give a general description of the products to the best of our knowledge. APOLLON RECORDS AS warrants that it has the right to supply all products offered by it on the website.
APOLLON RECORDS AS use Paypal as the provider of our checkout. This means that we might transfer your personal data in the form of contact and order details to Paypal when the checkout is loaded, in order for Paypal to manage your purchase. Your personal data transferred is processed in line with Paypal's notice.

1 a) AVAILABILITY, PRICES AND INFORMATION ON PRODUCTS
The price of the products shall be the price listed in Euro (EUR) or Norwegian Kroner (NOK) on the website on the date of your order (inclusive of Norwegian VAT, but exclusive of delivery charges which are payable by you). All prices displayed on the website are and must be paid in full, including delivery charges, except where discounts are offered as detailed on the website.
All products are offered for sale by Seller are subject to availability. Some products may be temporarily out of stock, and some may be permanently out of stock. Products may be offered for pre-order prior to the release date, meaning the date the product is available in the ordinary sale. Pre-orders are delivered when the product arrives to warehouse. Some products are produced as limited editions. Such products are subject to availability and are permanently sold out after. In the event, purchaser has ordered a product that cannot be delivered, purchaser will be notified as soon as possible after we clarify that the product cannot be delivered. In such an event, APOLLON RECORDS AS is in no event liable for any damages.
The price of freight is calculated in the webshop for the individual order, based on the current rates of the Post, the size and weight of the shipment, and the purchaser’s address. The cost of freight is based on which and how many items are ordered.
The contract is binding for both parties as soon as the Purchaser has sent the order to the Seller.
However, a party is not bound by the contract if there are orthographical or typological errors in the offer from the Seller in the ordering solution of the online shop or in the Purchaser’s order, and the other party realised or should have realised that such an error was present.

1 b) ORDERING

Org.nr. 915686664 Address: Nygårdsgaten 2, 5004 Bergen, Norway will treat the order as an offer by you to purchase the products subject to these terms and conditions of sale. You are responsible for ensuring the accuracy of your order and any specific delivery instructions and if APOLLON RECORDS AS accepts your offer they shall supply you, subject to availability, with the quantity and specification of products set out in your order.
If APOLLON RECORDS AS accept your offer they shall confirm each order online via the internet or by email and such confirmation shall be APOLLON RECORDS AS acceptance of the contract between the parties.

1 c) DELIVERY & RETENTION OF TITLE
Seller offers worldwide shipping. All orders are shipped post-delivery from our warehouse in Norway or in Spain, and all costs and time of delivery are subject to current post rates and delivery times to respective zones. We cannot guarantee that a shipment arrives within the Post’s estimated times.
All products will be delivered to the address that you register or have indicated on your PayPal account page and so far as possible in compliance with any specific delivery instructions, referred to above. The purchaser is responsible for ensuring that all information registered as part of a purchase is correct.
Whilst the risk of damage to or loss of the product(s) shall pass to you the purchaser upon leaving the premises of APOLLON RECORDS AS, title in the goods shall not pass until the whole purchase price including the cost of transport, has been paid in full. Customers will be responsible for paying any and all customs or import duty charges.
DELIVERY TIME
Any times quoted for delivery are approximate only and time shall not be of the essence. APOLLON RECORDS AS shall not be liable for any delay in delivery of the products howsoever caused.

APOLLON RECORDS AS will process your order as quickly as possible, normally within 1-4 business days, and when your order is shipped you will receive another email with your shipping information. We pack and send orders every weekday (Monday to Friday) except holidays. Orders placed on holidays will be processed the following working day.
APOLLON RECORDS AS shall confirm each order in writing by sending you a printout of the order along with your products.
As a customer you have the right to terminate a purchase if your order is delayed. If APOLLON RECORDS AS is aware of the delay, we will contact you as soon as possible regarding a new delivery date. It is up to you if want to accept waiting for the package or cancel the purchase.

1d) EXCHANGES and RETURNS
APOLLON RECORDS AS offers you the right to both return and exchange your order within 28 days, from the day you receive your order. Products on sale cannot be returned.
If any of our products fall below the high standards you expect please return them within 28 days and we will refund or exchange the item. Please have your invoice with you to do this. We will not refund the costs of return postage to us unless the products are faulty. You may not cancel your order once payment has been made via PayPal.
In your order confirmation, you will receive an exchange & return form, which you must fill out with the correct information and return together with the item. The customer is obligated to pay for the freight and is responsible for the package until it is marked as “delivered”.

Terms for International returns of goods
1. Any items that are being returned must be in perfect (unused, new) condition without any visible signs or damage, and must have the original label attached. Make sure the products are in the same condition in which they were delivered to you, with all identification tags, packaging, and seal still attached. Returns are closely inspected upon delivery and we reserve the right to refuse any returns that do not match these criteria.
2. Send us an e-mail to otto@apollonrecords.no with your return request. Await approval of return prior to shipping the item.
3. Place the item(s) in the original shipping box or any other solid carton box. Close the box and tape it securely. Print and fill out the return form sent to you by e-mail and put this along with the product. NB: It is important that you write down your order number, name, e-mail, and reason for the return.
4. If your return is accepted upon arrival at our warehouse, your return will be handled/refunded within 14 days from the time of arrival. 10% of the order value will not be refunded.
Valid return requires that the item is in its original condition.

Defect products
If the good is defective, the Purchaser must notify the Seller that he/she wishes to invoke the defect within a reasonable amount of time after the defect was discovered or should have been discovered. The Purchaser is always considered to have given timely notice if it occurs within two months after the defect was discovered or should have been discovered. Notice may be given no later than two years after the Purchaser took possession of the good. Notice shall be given to the Seller in writing.
If the good has a defect and this is not due to the Purchaser or to conditions on the part of the Purchaser, the Purchaser may, withhold the purchase sum, choose between a replacement of the product, or demand a price reduction, according to the relevant circumstances.

A price reduction means that the relation between the reduced and originally agreed price corresponds to the relation between the item’s value in a defective condition and the condition according to the original contract.

Uncollected packages
In the event a shipment is not collected within 14 days, the parcel will be returned and the customer will be charged for return shipping in addition to the costs for handling the return. In the event that Purchaser request that we ship out the product again, the extra post-delivery cost of the return will be invoiced.

2. PERSONAL DATA
When you make a purchase from this website, the personal information collected enables us to process and deliver your order. In doing so you consent to the recording, holding and using the personal data we collect about you. We are committed to the Data Protection legislation and completely dedicated to the privacy of our customers’ information.

3. LIMITATION OF LIABILITY
APOLLON RECORDS AS liability to you is limited to the price of the products purchased and the delivery cost involved and in particular, is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

4. CHANGES TO THE TERMS AND CONDITIONS OF SALE
Our terms and conditions of sale may be changed. Please review them regularly. If you continue to use the website after a change has been made you are deemed to have accepted it.

5. LAW AND JURISDICTION
These terms and conditions of sale shall be governed by and construed in accordance with the laws of Norway. Any disputes arising in relation to the website shall be subject to the exclusive jurisdiction of the courts of Norway. If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.
Conflict resolution
Claims must be directed to the Seller within a reasonable time frame. The parties shall attempt to resolve any disputes out of court. If this is not successful, the Purchaser may contact the Consumer Council of Norway for mediation.
